What formal guidance or oversight mechanisms are currently in place to regulate the use of derogation in promotion decisions? Specifically, how does PSNI ensure that any departure from standard procedure is justified, equitable, and subject to appropriate scrutiny?

Answer

In relation to promotions, a request for derogation refers to an appointment made outside of the established merit order, rather than a promotion without due process.

Such requests should only be made in exceptional circumstances where there is a demonstrable and urgent business need.

Applications must set out the rationale for the urgency, the specific skills or qualifications required for the role, the potential organisational impact if the request is not approved, and any implications for others affected by the decision.

Once all relevant information has been provided, the request will be initially reviewed by the relevant ACC/ACO. If the ACC/ACO is satisfied and supports the case, it will be referred to the Director of Human Resources for consideration, and ultimately to the Deputy Chief Constable for final approval.
